Acceptance of Terms and Conditions
1. ‘’The Great Burpple Christmas Giveaway’’ (‘’the Giveaway’’) is organised by Burpple Pte Ltd (‘’the Organiser’’).
2. By entering the Giveaway, you represent that you have read, understood and agreed to be bound by these terms and conditions, including any further amendments made to the following Terms and Conditions (the ‘’T&Cs’’).
3. The Organiser has the rights to amend the T&Cs by modifying, cancelling or suspending the Giveaway at its sole discretion at any time. Notice of any such amendments made will be posted onto the Organiser’s website, mobile-app, Facebook, Instagram, Telegram and LinkedIn platforms.
Eligibility
4. The Giveaway is open to persons who are:
(a) Singapore citizens or Permanent Residents;
(b) residing in Singapore;
(c) above 18 years of age, or if below 18 years of age have obtained consent from his/her parent or legal guardian to enter this Giveaway and to be legally bound by the T&Cs. Participants must submit proof of parental or guardian consent for their entry into the Giveaway, if required by the Organiser; and
(d) who are not employees of the Organiser [or the Organiser’s appointed social media agency managing this Giveaway], or the immediate family members of such employees.
Entry Submission of Giveaway
5. The Giveaway is open for submission of entries from 12th December 2020 to the 25th December (Singapore Time) (‘’Giveaway Period’’).
6. To make a valid entry for the Giveaway:
(a) Follow the Organiser’s official Facebook, Instagram, Telegram and LinkedIn platforms, or visit Burpple website (www.burpple.com)/Burpple mobile app.
(b) Follow the respective steps in the Giveaway post with the prerequisite to enter the lucky draw with 1 chance (equivalent to 1 lucky draw entry) being to download the Burpple mobile application and/or update the Burpple mobile application to the latest app version 7.3.10/7.3.11.
(c) Follow other steps to increase your chances of winning the Giveaway includes editing your profile to fill 4 fields (Birthday, Gender, Postal Code & Work Location); signing-up for Premium (for Non-Beyond members) with code <XMAS30> for 30% off; successfully referring 1 friend to sign up for Premium; and redeeming 4 Beyond deals during 12th December 2020 to the 23rd December 2020 (Singapore Time).
7. You may increase your chances with more successful referrals, but you can only win one (1) prize. Chances stated are equivalent to the number of lucky draw entries. Entries will be tabulated and winners will be selected at random.
8. Entries must be submitted during the Giveaway Period. Entries submitted before or after the Giveaway Period will not be accepted.
9. By making an entry submission, you consent that:
(a) you represent and warrant that you are the authorised account owner of the Premium account used to submit the entry;
(b) you agree that the Organiser will credit you in any use of the entry, and may disclose your name and particulars of the entry for publicity purposes;
(c) should your entry be selected as a winning entry, you agree to cooperate and participate in publicity activities which include photographs, videos, interviews or any other features as required by the Organiser; and
(d) you confirm that you are not in violation of any law or regulation by entering the Giveaway.
10. The Giveaway is in no way sponsored, endorsed, administered by, or associated with, Facebook, Instagram, Telegram and LinkedIn. You agree to release Facebook, Instagram, Telegram and LinkedIn from any claims. Any questions, comments or feedback made relating to the Giveaway are to be addressed to the Organiser only and not to the abovementioned platforms. You also acknowledge that by opening an account with Facebook, Instagram, Telegram and LinkedIn and using their services, products or features, you are responsible for complying with their terms and conditions and the Organiser shall not be liable in any way for such account and usage.
Entries and Prizes
11. All decisions by the Organiser relating to the Giveaway are final. The Organiser is not obliged to provide reasons concerning the judgement and/or selection of the winning entries or entertain any appeals whatsoever.
12. The Organiser will select winning entries by 31st December 2020 and each winner will be entitled to receive either and only one (1) of the following prizes, according to the days of the Giveaway Period: (1) SGD$100 daily voucher from merchants (Total of 15 x $100 dining vouchers) ; (2) iPhone 12 (1 x iPhone 12 valued at $1,299) ; (3) Resorts World Sentosa Staycation Package.
13. Lucky draw entries (chances) will be tabulated. The Organisers will select winners at random and will announce the winners on their Facebook, Instagram and Telegram platforms on 31st December 2020. Winners will be notified and provided instructions on prize collection through Facebook, Instagram and Telegram direct message.
14. Should any winner remain uncontactable or does not respond to the Organiser’s notification within 7 days OR a reasonable period of time, the Organiser reserves the right to select a replacement winner or forfeit the prize, and the originally selected winner shall not be entitled to any payment or any form of compensation from the Organiser.
15. Prizes are non-negotiable, non-transferable, non-refundable and cannot be exchanged for cash or other forms of value. All winners of the Giveaway agree to accept the prize in its current condition at the time of collection and are also solely responsible for any taxes, fees and/or other additional costs that may be incurred relating to the acceptance of the prize.
16. The Organiser makes no warranties, representations or guarantees either expressed or implied relating to any prize, including but not limited to any warranty of merchantability or fitness for a particular purpose.
17. The Organiser reserves the right to disqualify any entry deemed to be incomplete, fraudulent, misleading, deceptive, defamatory or otherwise inappropriate in the sole and absolute opinion of the Organiser at any time. The Organiser also reserves the right to forfeit the claim of any prize at any time if the Organiser deems that there has been a breach of the T&Cs by any winner during or after the Giveaway Period.
18. The Organiser may in its sole and absolute discretion substitute, withdraw and/or cancel any prize or alter the value and/or number of prizes at any time without prior notice. The Organiser is also not obliged to provide reasons for exercising such right and shall not be liable for any payment or any form of compensation to any person due to such changes.
19. The Organiser reserves the right to amend the Rules and Regulations without giving prior notification or any reasons thereof.
Liability and Indemnity
20. To the fullest extent permissible under law, the Organiser shall not be liable for any loss, damage, injury or any other costs relating to any person’s entry and participation in the Giveaway, including but not limited to any alteration of the prizes, disqualified entries, winner’s acceptance and use of his/her prize and any delay, cancellation, failure or omission on the Organiser’s part to carry out the Giveaway whether due to force majeure events or otherwise.
21. You agree to indemnify the Organiser from and against all liabilities, losses, damages, proceedings, suits, actions, claims and demands as well as any other costs (including legal costs on a full indemnity basis) incurred by the Organiser relating to your entry and/or any breach of the T&Cs by you.
Personal Information
22. You agree that the Organiser may collect, use and disclose your personal data (including but not limited to your name, Facebook, Instagram and/or Telegram handles and profile pictures) as provided to the Organiser for the following purposes: (1) organising and administering the Giveaway and in relation to your participation; (2) promotional, marketing and publicity purposes relating to the Giveaway and the Organiser; (3) for the Organiser to conduct of research, analysis and development activities (including data analytics, surveys and/or profiling) in order to enhance the Organiser’s programme offerings and operations; and (4) for the Organiser’s reference and archival purposes. The Organiser may share this data with other Government agencies (or non-Government entities authorised to carry out specific services by the Organiser) if necessary, in order to serve you in the most efficient and effective way, unless such sharing is prohibited by legislation. Governing Law and Jurisdiction
23. The T&Cs shall be governed by and construed in accordance with the laws of the Republic of Singapore for every purpose and you acknowledge and agree to submit to the exclusive jurisdiction of the Singapore courts.
